Risk Disclaimer and Educational Content Notice
Effective date: 1 November 2026 | Version: 2.0
Who this disclaimer covers
This disclaimer is issued jointly by two related companies:
- The Daily Profiler, LLC, a South Carolina limited liability company ("The Daily Profiler").
- Pack Trading LLC, doing business as The Pack Trade Group, a West Virginia limited liability company ("The Pack Trade Group").
In this disclaimer, "we", "us" and "our" mean either or both companies, together with their owners, members, managers, officers, employees, contractors, coaches, moderators and agents.
This disclaimer applies identically to both companies and to everything either of them publishes or provides. That includes:
- thedailyprofiler.com and the account hub at auth.thedailyprofiler.com;
- the Trading Journal;
- The Daily Profiler Bootcamp at thedailyprofilerbootcamp.com, with its lessons, simulators and quizzes;
- tools.thedailyprofiler.com;
- packtradegroup.com and The Pack Discord community;
- live trading sessions;
- the GunShip software and GunShip Updater;
- our TradingView indicators;
- our Whop store listings;
- our emails, videos, social posts and release notes.
We call these, together, the "Services". The same text is published on both companies' websites. It forms part of each company's terms, and you acknowledge it when you create your account.
1. Education and software only. Not advice.
Everything we publish or provide is for educational and informational purposes only. That includes courses, lessons, live sessions, Discord discussions, indicators, tools, the GunShip software, examples and statistics.
Nothing in the Services is investment, financial, trading, tax or legal advice, or a recommendation or solicitation to buy or sell any futures contract, security or other financial product.
- We do not know your finances, objectives or tolerance for risk.
- We do not tell any individual what to trade, how much to trade, or which account to use.
- Defaults, presets, example settings, example portfolios, and settings that staff or other members show or share are examples, not recommendations.
Before you trade, consider getting advice from a licensed professional who knows your situation.
2. Registration status
Neither The Daily Profiler, LLC nor Pack Trading LLC is registered with the Commodity Futures Trading Commission or the National Futures Association as a commodity trading advisor, commodity pool operator or futures commission merchant. Neither is registered as an investment adviser or broker-dealer.
We do not hold, manage or have access to your funds or trading accounts. We do not place trades for you. We will never ask for your broker or prop-firm password, or for remote access to your computer.
3. Risk of loss
Trading futures and other leveraged products involves substantial risk of loss and is not suitable for all investors. You may lose all of your initial investment, or more.
- Leverage magnifies losses as well as gains.
- Gaps, fast markets, low liquidity, news events, contract rollovers, exchange halts and shortened sessions can cause fills far from the price you intended, and losses larger than any stop.
- Only trade with risk capital: money you can afford to lose without affecting your financial security or way of life.
4. Hypothetical and simulated performance (CFTC Rule 4.41)
Unless a result is clearly labeled as a verified record of actual live trading, every performance figure we show is hypothetical. That includes:
- backtests, strategy-analyzer and walk-forward results;
- simulator, practice and "sim" account results;
- research simulations;
- example trades in lessons;
- charts, screenshots and statistics.
The following statement applies to all of them:
THESE RESULTS ARE BASED ON SIMULATED OR HYPOTHETICAL PERFORMANCE RESULTS THAT HAVE CERTAIN INHERENT LIMITATIONS. UNLIKE THE RESULTS SHOWN IN AN ACTUAL PERFORMANCE RECORD, THESE RESULTS DO NOT REPRESENT ACTUAL TRADING. ALSO, BECAUSE THESE TRADES HAVE NOT ACTUALLY BEEN EXECUTED, THESE RESULTS MAY HAVE UNDER- OR OVER-COMPENSATED FOR THE IMPACT, IF ANY, OF CERTAIN MARKET FACTORS, SUCH AS LACK OF LIQUIDITY. SIMULATED OR HYPOTHETICAL TRADING PROGRAMS IN GENERAL ARE ALSO SUBJECT TO THE FACT THAT THEY ARE DESIGNED WITH THE BENEFIT OF HINDSIGHT. NO REPRESENTATION IS BEING MADE THAT ANY ACCOUNT WILL OR IS LIKELY TO ACHIEVE PROFITS OR LOSSES SIMILAR TO THESE BEING SHOWN.
Hypothetical results can differ greatly from live results for many reasons, including:
- commissions and fees;
- slippage and partial fills;
- queue position and order-routing delay;
- differences between historical and live data;
- the fill assumptions of the platform that produced them.
Past performance, whether actual or simulated, is not indicative of future results.
5. Journaled, shared and live results
- Journal records. Results recorded in the Trading Journal, imported from a broker or platform, or shown in its analytics are records of past trades only. They are subject to entry and import errors, and are reviewed with the benefit of hindsight. They do not predict future results.
- Live sessions. When staff or guests trade live in a session, or share their trades, their results are not representative of what any member will achieve. Their account size, risk, experience and timing differ from yours. Their results are no guarantee of future performance. Sharing a trade is not a recommendation to take it.
- Staff positions. Our staff, coaches and owners may trade the same instruments as the Services discuss, at the same time or at other times, in the same or opposite direction. They are not required to disclose their trades.
6. No earnings claims or guarantees
We make no promise or guarantee of income, profit or any trading result from using the Services. That includes passing a prop-firm evaluation, reaching a profit target, staying within a drawdown limit, or receiving a payout.
- Individual results vary widely with experience, skill, discipline, risk management, capital and market conditions.
- Any example of a trade, profit or income is for illustration only, and is not typical.
- Trading education does not guarantee trading success.
7. Testimonials and member results
Any testimonial, review, screenshot or member result that we publish, or that is shared in our communities:
- may not be representative of the experience of other members;
- is no guarantee of future performance or success;
- comes from a member who was not paid, given free access, discounts or anything else of value for it. If that ever changes for a testimonial, we will say so next to it.
A screenshot from a simulated or evaluation account is labeled "simulated account".
8. Software, indicators, tools and automation
Our software, indicators, simulators, calculators and the Trading Journal are tools. They are not buy or sell signals.
-
Software fails. Bugs, platform crashes, disconnects, bad or delayed data, rejected or orphaned orders, position mismatches, slippage, and updates that change behavior can all cause losses. Those losses can be larger than you intended.
-
Automated trading (including GunShip) places, changes and cancels real orders without asking you before each trade. It can stop at any time, including in the middle of a trade, if:
- your membership ends;
- a payment fails;
- a license check fails;
- a service is unavailable.
When that happens, it can leave positions or orders open that you must manage yourself. Built-in loss limits and kill switches are not guaranteed.
-
Your duties. You must supervise any automated tool whenever it runs on a live or funded account. You must keep the ability to close positions manually through your broker. You must test every new version and setting in simulation before using it live.
-
Indicators. An indicator can differ from a strategy that uses similar ideas, and can change between versions. Anything you connect it to is at your own risk.
-
Calculators and analytics depend on the inputs you give them, and can be wrong.
Use of GunShip is also governed by the GunShip Software License, Risk Disclosure and Release of Liability, which you must accept before you use it.
9. Prop firms, brokers and platforms
You are responsible for knowing and following the rules of your broker, your platform, and any prop firm you trade with, including rules on automated trading, third-party software, copy trading and multiple accounts.
We make no claim that any tool, method or setting is allowed by, approved by, or compatible with any prop firm. We are not responsible for:
- failed evaluations, resets or fees;
- account closures;
- denied payouts.
Brokers, platforms, data providers, prop firms, Whop, Discord, TradingView and NinjaTrader are independent third parties, and we are not responsible for them. We are not affiliated with or endorsed by NinjaTrader or TradingView.
10. Your responsibility
Every trading decision you make, and its outcome, is yours alone. That includes:
- what you trade;
- how much you trade;
- when you trade;
- which account you trade in;
- whether you use any tool, setting or idea from the Services.
You are responsible for the taxes on your trading, and for making sure that your trading, and your use of the Services, is lawful where you live.
11. No reliance
Do not rely on any statement, result, screenshot, video, live session or Discord message about profitability, prop-firm compatibility or future performance. That applies whether it comes from us, our staff or another member. Our written terms and agreements are the only promises we make.
12. Limitation of liability
To the fullest extent the law allows, neither company is liable for:
- trading losses;
- lost profits or opportunities;
- prop-firm fees, resets or payouts;
- any indirect, incidental, special, consequential or punitive damages arising from your use of the Services.
The full disclaimers of warranties, limitations of liability, indemnities, governing law, arbitration agreement and class-action waiver are in:
- the Terms of Service, which cover both The Daily Profiler, LLC and Pack Trading LLC (arbitration and class-action waiver, with a 30-day opt-out); and
- for GunShip, the GunShip Software License, Risk Disclosure and Release of Liability (West Virginia law; arbitration and class-action waiver, with a 30-day opt-out).
Under both companies' terms, our total liability is capped at the greater of the amount you paid that company in the 12 months before the claim, or US$100. Nothing in this disclaimer limits liability that the law does not allow to be limited.
13. Changes
We may update this disclaimer. We post each version on both companies' websites with a new effective date and version number. You may be asked to acknowledge the new version when you next sign in.
